This Hosting Acceptable Use Policy (“AUP”) sets out the terms under which hosting services provided by Blake Mark Productions Ltd (“Agency”, “we”, “us” or “our”) may be used. By using our hosting services, you (“Client”) agree to comply with this AUP.
1. Prohibited Uses
The Client agrees not to use the hosting services for any unlawful, harmful, or abusive activities, including but not limited to:
- Illegal Activities – Any activity that violates local, national, or international laws, including copyright infringement, fraud, or the hosting of illegal content.
- Fraudulent or Deceptive Practices – Engaging in phishing, impersonation, or fraudulent transactions.
- Harmful Content & Malware – Uploading or distributing viruses, worms, trojans, ransomware, spyware, or any malicious code that could damage, interfere with, or disrupt our network or services.
- Spam & Unsolicited Communications – Sending or facilitating the transmission of bulk unsolicited emails, spam, or maintaining an open SMTP relay.
- Network & System Attacks – Engaging in Denial-of-Service (DoS) attacks, hacking, or attempting to bypass authentication systems.
- Resource Abuse – Excessive use of system resources that impact the performance of other clients on shared hosting servers, including bulk file storage, media streaming, and cryptocurrency mining.
- Reselling Hosting Services – Unless subscribed to an approved reseller plan, the Client may not resell hosting services to third parties.
- Unauthorized Access Attempts – Attempting to gain unauthorized access to any network, data, or system.
- Content Restrictions – Hosting content that is defamatory, obscene, offensive, discriminatory, or violates any applicable regulations.
- Harm to Minors – Hosting, distributing, or promoting material that exploits or harms minors in any way.
2. Communication Standards
All communication and content hosted or transmitted via our services must adhere to ethical and legal standards, including:
- No Defamatory or Obscene Content – Content must not include hate speech, threats, or material that is offensive or deceptive.
- Respect for Privacy – Users must not engage in harassment, invasion of privacy, or disclosure of personal data without consent.
- Compliance with Intellectual Property Rights – Clients must have legal rights to all content hosted on our servers and ensure no copyright violations.
3. Resource Usage & Limits
Our shared hosting services are designed for website hosting only. The following limitations apply:
- Storage & Bandwidth Usage – Unusual spikes in disk space or bandwidth usage may result in service restrictions or required upgrades.
- Backup & Archival Restrictions – Hosting accounts may not be used for storing excessive backups or archives. Backups older than 7 days may be removed.
- Cloud Applications & File Storage – Personal cloud storage solutions (e.g., OwnCloud, NextCloud) are prohibited.
- Excessive Resource Consumption – Clients consuming excessive CPU, memory, or I/O resources may be required to upgrade to a dedicated server or higher-tier hosting plan.
4. Suspension & Termination of Services
We reserve the right to suspend or terminate hosting services under the following circumstances:
- Non-Payment – Overdue invoices beyond the specified period will result in automatic suspension.
- Security Threats – If malware, compromised accounts, or security breaches are detected, immediate suspension may be required to protect other users.
- AUP Violations – If the Client breaches any part of this AUP, we may suspend or terminate services without prior notice.
- Excessive Resource Usage – If the Client’s hosting usage negatively impacts server performance, we may impose limits or request the Client to upgrade to a higher-tier plan.
- Legal Violations – If hosting content or activity is found to be illegal, services may be terminated without notice.
5. Amendments & Updates
We may update this Acceptable Use Policy from time to time. Clients are expected to review this policy periodically to remain compliant. Continued use of our hosting services constitutes acceptance of the latest version of this policy.
