These Terms set out the agreement between Blake Mark Productions Ltd, a company registered in England & Wales (No. 15804012) whose registered office is 124 City Road, London, EC1V 2NX (“we”, “us”, “our”), and the customer purchasing hosting services (“you”, “your”).
By ordering or using our hosting services, you agree to be bound by these Terms, together with our Hosting Service Level Agreement (SLA) and Hosting Acceptable Use Policy (AUP), which form part of this contract.
1. Definitions
- Services – website hosting, domain registration or transfer, email hosting and related technical services.
- Client Area – the online portal where your account, invoices, and support tickets are managed.
- Hosted Content – any files, databases, or email stored on our systems under your account.
- Renewal Date – the date an existing hosting term renews unless cancelled in line with clause 9.
2. Contract Formation
2.1 Your order constitutes an offer to purchase Services. The contract is formed when we issue an order confirmation or activate your account.
2.2 The contract term is as shown on your invoice (monthly or annual). Services renew automatically unless cancelled under clause 9.
2.3 You are responsible for ensuring all information provided during checkout is accurate and up to date.
3. Service Scope
3.1 We provide secure, UK-based website hosting using enterprise-grade infrastructure.
3.2 We aim to deliver 100% network uptime, using commercially reasonable efforts to maintain service availability at all times. Scheduled maintenance, emergency updates, or events beyond our control are excluded.
3.3 Your use of our hosting services is governed by our Hosting Service Level Agreement (SLA) and Hosting Acceptable Use Policy (AUP), available at https://blakemarkproductions.com/legal/.
3.4 We may perform maintenance or upgrades with at least 24 hours’ notice where practicable. Urgent work may be carried out without prior notice to protect service stability or security.
4. Technical Support
4.1 Hosting support covers server-level technical issues only, including:
- network connectivity, uptime, and performance
- DNS, SSL, or email delivery configuration
- control panel access, backups, and system diagnostics.
4.2 Support does not include website content or application-level issues such as WordPress configuration, plugins, or design errors. These are covered under our Website Support & Maintenance Plans, available separately.

5. Client Responsibilities
5.1 You are responsible for:
- the legality, accuracy, and security of your Hosted Content;
- maintaining independent backups of your website and data;
- ensuring all scripts, plugins, and CMS installations remain updated and secure;
- compliance with the AUP and applicable laws, including UK GDPR and ePrivacy regulations.
5.2 You must not use hosting space for unrelated file storage, personal cloud storage, media streaming, or cryptocurrency mining.
5.3 You are solely responsible for your login credentials and any activity conducted under your account.
6. Domains and Email
6.1 Domain registrations, renewals, and transfers are provided as part of our Services. We act as your registrar or through an accredited registrar.
6.2 We do not guarantee the successful registration or renewal of any domain name. If a requested domain is unavailable or premium-priced, we will notify you before processing payment.
6.3 Email hosting is provided for business use only. Sending unsolicited bulk mail, spam, or facilitating spam transmission breaches our AUP and may result in suspension.
6.4 Domain Registration Compliance
Domain registrations, renewals, and transfers are subject to the rules of the relevant registry. By registering or transferring a domain, you agree to abide by all applicable registry and registrar terms.

- Other country-code domains (ccTLDs) are subject to their respective registry rules.
6.7 Premium or Restricted Domains
Certain domains may incur higher registration or renewal costs (“premium domains”) or be subject to eligibility restrictions. You will be notified before any such registration proceeds.
7. Fees and Payment
7.1 Hosting services are billed monthly or annually as selected at checkout.
7.2 All plans renew automatically on the Renewal Date unless cancelled in accordance with clause 9.
7.3 Invoices are issued approximately 30 days before renewal and must be paid before the Renewal Date to ensure uninterrupted service.
7.4 If payment is not received by the Renewal Date, services may be suspended automatically until full payment is made.
7.5 All fees are exclusive of VAT unless otherwise stated.
7.6 Late payments incur statutory interest and fixed recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998.
7.7 We may revise pricing upon renewal, giving at least 30 days’ notice via email or your client portal.
8. Data Protection
8.1 We act as a data processor in relation to any personal data stored or processed on our hosting platform.
8.2 We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
8.3 You remain the data controller for any personal data held within your Hosted Content and are responsible for ensuring all data is lawfully collected and processed.

9. Cancellation and Termination
9.1 You may cancel hosting by submitting a cancellation request via your Client Area at least 30 days before the Renewal Date.
9.2 We may suspend or terminate services immediately if you:
- breach these Terms, the SLA, or the AUP;
- fail to pay invoices on time;
- host illegal or malicious content; or
- cause security or stability risks to our systems.
9.3 Upon termination, we will make a downloadable copy of your Hosted Content available for 7 days, after which all data will be permanently deleted.
9.4 Prepaid annual fees are non-refundable once the hosting term has commenced, except where required by law.
10. Liability
10.1 Nothing in these Terms limits or excludes liability for death, personal injury, or fraud.
10.2 Except as required by law, we are not liable for:
- loss or corruption of data or backups;
- downtime caused by third-party software, cyberattacks, or force majeure events;
- indirect or consequential losses, including loss of profit, revenue, or goodwill.
10.3 We provide no guarantee that the Services will meet your specific requirements or operate error-free.
10.4 To the fullest extent permitted by law, our total liability for any claim arising out of or in connection with the Services shall be limited to a level that is fair and proportionate to the nature of the claim and the value of the Services provided.
11. Force Majeure
We are not responsible for any failure or delay caused by events outside our reasonable control, including but not limited to power or network failures, cyberattacks, pandemics, or natural disasters.
12. Amendments and Notices
12.1 We may update these Terms, the SLA, or the AUP from time to time to reflect service or legal changes.
12.2 Updates take effect 30 days after publication on our website.
12.3 Notices may be given by email or via the Client Area and will be deemed received 24 hours after sending.
13. Governing Law and Jurisdiction
These Terms and any dispute or claim arising from them are governed by and construed in accordance with the law of England and Wales. The courts of England shall have exclusive jurisdiction.
14. Entire Agreement
These Terms, together with the Hosting SLA, Hosting AUP, and your order confirmation, constitute the entire agreement between you and Blake Mark Productions Ltd for hosting services.
